These Terms and Conditions are subject to change without notice, from time to time at our sole discretion. Biking BA will endeavor to communicate the most updated Terms and Conditions to our passengers when changes occur.
1. Definitions
‘Biking BA’ shall mean Biking Buenos Aires. ‘You’ or ‘passenger’ shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same is made. ‘Force Majeure’ shall mean any event outside Biking BA’s control, including but not limited to war and civil strife etc., which prevents the prompt performance of its obligations.
2. General Information
General information included in the website (www.bikingbuenosaires.com) is for help and guidance. The contract incorporating these conditions shall be governed by Argentine law and any matters arising out of it shall be subject to the jurisdiction of the Courts of Argentina, Ciudad Autónoma de Buenos Aires.
3. Tours
3.1 Each regular tour has a fixed lenght and duration… On the occasion that an attraction is closed or the group experiences an unforeseen event (flat tire, protest, etc.) the tour may last more or less than the originally stated time. The routes are fixed; however, due to unexpected road closures, protests, traffic, etc., we sometimes have to find the next best alternate route. Only private tours are allowed to customize tours to their specifications so long as the tour doesn’t exceed the indicated maximum time (please see point 3.4 and 3.5).
3.2 The minimum number of passengers to start any group tour is one unless specified otherwise. In the rare event that the passenger wants to join a different group tour than the one reserved, Biking BA will work with the passenger to make an alternative arrangement that best suits the situation.
3.3 Private tours require at least 2 business days to schedule or reschedule.
3.4 Private tour guides are booked for a certain amount of hours, upon agreement between Biking BA and the passenger(s). At the discretion of the guide’s availability, if a private tour exceeds the agreed upon length of time, the price is 30 USD per extra hour (per group). The extra hour begins at 30 minutes after the agreed upon end time. The guide reserves the right to accept or decline working beyond the agreed upon hours.
3.5 In the case of a private tour, special itinerary requests and detours need to be made in writing to Biking BA at least 2 business days before the scheduled tour, in order for Biking BA to conduct adequate research and make appropriate arrangements for the route design.
4. No Show and Late Arrival Policy
4.1 If the passenger does not arrive to the tour (20 minute window) and does not give any notice beforehand, it is considered a “no-show.” No refund whatsoever will be issued to no show passengers.
4.2 In any situation where the passenger(s) do not show up for their scheduled tour and they are the only passenger(s) in the tour, Biking BA reserves the right to cancel the tour after 20 minutes of waiting unless notification of late arrival has been made in advance.
4.3 Tours start and end as scheduled by Biking BA. If a passenger arrives late, the tour time missed is not refundable but may be changed to another tour date against a rescheduling fee of 20 USD per passenger, depending on schedule availability. Special conditions apply to tours booked between December 20th of a given year and January 5th of the immediately following year (please see point 10.4 and 10.5).
4.4 If a passenger arrives late to a private tour, Biking BA reserves the right to alter (shorten) the itinerary accordingly in order for the tour to end at the agreed upon time.
5. Travel Documents and Insurance
The passenger is fully responsible for having all necessary valid travel documents, travel insurance and medical insurance. Any non-compliance and any resulting damages are the sole responsibility of the passenger.
6. Prices
The prices stated on the website are the official charges; prices in any printed flyers, brochures, advertisements or other materials are for indication only. Prices are subject to change at any time. In the case that only partial payment was made by a passenger and the prices changed, it is at the discretion of Biking BA to decide whether or not to honor the price from the time of booking to the passenger upon completion of the full payment.
7. Discounts
7.1 Discounts for private group tours are solely up to the discretion of Biking BA and are subject to change if the original agreement is modified.
7.2 Discounts that are offered directly by Biking BA cannot be combined with any other discounts offered by third parties, unless stated otherwise.
8. Booking and Payment
8.1 Due to the limited capacity of each tour, spots are available according to reservations and then on a first come, first served basis. Therefore, the spot is not guaranteed and booking is not finalized until full payment has been processed and a confirmation receipt has been issued. Full payment must be paid before the tour.
9. Special Requirements
Any special requests must be advised to Biking BA at the time of reserving the tour in writing.
10. Cancellation, Reschedule, Refund & Rain Policy
10.1 If a passenger wants to cancel or reschedule a booking, the request must be made to Biking BA in writing. The date/time of cancellation or rescheduling will be the date/time that Biking BA receives the letter or email.
10.2 If a passenger wants to reschedule a booking, Biking BA offers 100% credit to a tour of less or equal value in the future, without charge if Biking BA is notified more than 24 hours before the tour start, or against a reschedule fee of 20 USD per passenger if Biking BA is notified within 24 hours of the tour start. The rescheduled date will depend on the tour schedule availability. Special conditions apply to rescheduling of tours booked between December 20th of a given year and January 5th of the immediately following year (please see point 10.5).
10.3 If a passenger wants to cancel a booking, Biking BA offers a 100% refund if the reservation is cancelled more than 24 hours (1 day) prior to the scheduled tour. If the cancellation request is within 24 hours of the tour start time Biking BA will refund 50% of the payment. Special conditions apply to cancellation of tours booked between December 20th of a given year and January 5th of the immediately following year (please see point 10.4).
10.4 No refunds will be issued if a reservation is cancelled for any reason within 24 hours of the tour start time for tours booked between December 15th of a given year and January 10th of the immediately following year.
10.5 If a passenger booked on a tour taking place between December 15th of a given year and January 10th of the immediately following year, wants to reschedule his/her tour (regular or private) within 24 hours of the tour start time, no money will be refunded and a new reservation can be made at the full price.
10.6 Rain Policy- In the case of rain, it shall be assumed that the tour will be going as scheduled unless otherwise notified by Biking BA to the passenger. Biking BA will cancel the tour in cases of extreme weather that compromise the safety of the passengers which include lightning, thunder and/or flooding. Biking BA provides rain ponchos and other measures to mitigate the weather, therefore, if the tour goes out and the passenger decides to cancel their booking, he/she will be refunded 50% of their payment or given 100% credit to a future tour of equal or less value (credit does not guarantee seat availability).
11. Changes by Biking BA
Biking BA reserves the right to modify or cancel its services arrangements if unforeseen circumstances arise. If Biking BA cancels or significantly changes the elements of a booked program due to force majeure, on or before the start date of such program, Biking BA will inform the passenger as soon as possible and will put its utmost effort to arrange alternatives that are of equal value. If force majeure occurs while the program is in progress, Biking BA will try to make reasonable alternative arrangements as well.
12. Liability of Biking BA
Biking BA is responsible for ensuring that all services are supplied as described and that they all reach reasonable standard. However, Biking BA will not be liable for the failure or improper performance of these products and services where such failure or improper performance is attributable to a) the fault of the passenger, b) the unforeseeable or unavoidable actions of an unconnected third party, c) unusual and unforeseeable circumstances beyond Biking BA’s control, including force majeure.
13. Codes of Conduct
Passengers are expected to behave respectfully to others, including but not limited to fellow passengers, guides, staff and/or activity personnel, and to the property of others, including but not limited to shared facilities and public environment. Also, passengers are expected to obey the laws and adapt to the customs of the country they travel in. The Codes of Conduct is outlined as such and serves as a guideline for all Biking BA passengers to follow.
Biking BA reserves the right to remove a passenger from his/her tour if such passenger violates the Codes of Conduct. No refund will be given, and the passenger must pay the full compensation for any damages that might have been caused.
14. Privacy Policy
All the personal information that is collected during the Biking BA registration process will be used for Biking BA administration and booking purposes only. Biking BA does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you’ve requested. Biking BA may occasionally send news, such as information on our current events, special events happening in Buenos Aires during your stay, special promotions etc. to your provided email address. You can always reply to unsubscribe at anytime.
